Terms of Service

These Terms of Service ("Terms") govern your use of the Fumi translation management platform at usefumi.com and app.usefumi.com (the "Service", "Fumi", "we", "us"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a company, you confirm you have authority to bind that company, and "you" refers to it.

1. Accounts

You must be at least 16 years old to use the Service. You are responsible for keeping your sign-in method secure and for all activity under your account. Workspace owners and admins are responsible for the members they invite and the permissions they grant.

2. The Service

Fumi lets you upload translation files, manage keys and strings, generate translations with AI, collaborate with your team, and export the result. We may add, change, or remove features over time. We will give reasonable notice before removing a feature that materially affects paid plans.

3. Plans, credits, and billing

Credits. Translating one key into one language consumes one credit. Each plan includes a monthly credit allowance that resets at the start of every billing period. Unused credits do not roll over. Storage, Translation Memory reuse, and exports do not consume credits.

Free plan. The free plan has no charge and is limited in credits, projects, languages, and seats as described on our pricing page. We may change free plan limits at any time.

Paid plans. Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. Prices are listed on our pricing page in US dollars and exclude any applicable taxes, which we will add where required. Your subscription renews automatically until you cancel.

Overage. On paid plans that allow it, you may continue translating after your monthly credit allowance is used up. Overage credits are billed at the rate shown on the pricing page at the end of the billing period. You can set an overage budget, including zero, in your workspace billing settings; once it is reached, translation pauses until the next period.

Changes and cancellation. You can upgrade, downgrade, or cancel at any time from your workspace settings. Upgrades take effect immediately and are prorated. Downgrades and cancellations take effect at the end of the current billing period, and you keep access until then.

Refunds. Fees are non-refundable except where required by law. If you believe you were charged in error, contact us within 14 days of the charge and we will review it.

Price changes. We may change prices with at least 30 days' notice by email. Changes apply from your next billing period after the notice.

4. Your content

You retain all rights to the files, strings, glossaries, and other content you upload or create in the Service ("Your Content"). You grant us a limited licence to host, process, and transmit Your Content solely to provide the Service to you, including sending it to AI model providers when you request a translation. We do not use Your Content to train machine-learning models.

You are responsible for Your Content and confirm you have the rights needed to upload it. You must not upload content that is unlawful, infringes others' rights, or contains malware.

5. AI translations

AI translations are generated automatically and may contain errors, omissions, or culturally inappropriate phrasing. They are provided as a starting point and you are responsible for reviewing them before use. We make no guarantee about the accuracy or fitness of any AI-generated translation.

6. Acceptable use

You must not:

• Use the Service in a way that breaks the law or infringes anyone's rights.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Interfere with or disrupt the Service, or circumvent usage limits or billing.
• Resell or sublicense the Service without our written permission.
• Use automated means to extract data from the Service beyond what the API permits.

7. Our intellectual property

The Service, including its software, design, and documentation, belongs to us and our licensors. These Terms do not give you any rights in it beyond the right to use the Service as intended.

8. Termination

You can delete your account or workspace at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your account has been inactive on the free plan for more than 12 months. Where practical we will give you notice and an opportunity to export Your Content first. Sections 4, 9, 10, and 11 survive termination.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or USD 100 if you have not paid us anything.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing law

These Terms are governed by the laws of Australia, and any dispute will be resolved in the courts of Australia, without prejudice to any mandatory consumer-protection rights you have where you live.

12. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the date above, and for material changes we will notify you by email or in the Service at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
